Any rental date that includes Christmas or New Year’s Day is non cancellable and non-refundable under any circumstances, and cancellation will result in a 100% forfeiture of all monies paid.
For all other dates: If we receive written notice of cancellation at least 120 days in advance of the COMMENCEMENT DATE, any monies prepaid will be refunded, less 10% of the TOTAL RENTAL FEE, which will be deducted and withheld as a cancellation penalty.
If we receive written notice of cancellation at least 90 but less than 120 days in advance of the COMMENCEMENT DATE, all monies prepaid will be refunded, less 50% of the TOTAL RENTAL FEE, which will be deducted and withheld as a cancellation penalty.

Any cancellation less than 90 days prior to the COMMENCEMENT DATE will result in forfeiture of all monies paid.

Upon advance written request, we will consider transfer of your existing reservation to another qualified person you may designate or, if the VILLA is available during another period within a reasonable time of the period reserved, we may, in our discretion, allow the prepaid monies to be applied to a different period of rental.

No refund or adjustment will be provided due to interruption or cancellation of your travel, or for other circumstances beyond our control such as weather or political situations. We highly recommend you purchase trip cancellation insurance from a third party.

You and We agree to the following terms and conditions as part of the rental agreement: 1. VILLA RENTAL. The rental of the VILLA includes the exclusive use during the term hereof of all public rooms, gardens, bedrooms, pools, recreation facilities, and other amenities and elements of the VILLA, but shall exclude use or occupancy of any portion of the VILLA dedicated to staff, mechanical operations, maintenance, operations, commercial kitchen facility, and the owner’s unit. The VILLA shall also include use of the beach Cabana and associated perquisites and rights at the Sandy Lane Hotel as may otherwise be made available to the VILLA by that entity, but the exact use and function of such rights associated with use of beach and Hotel facilities change periodically and are not guaranteed. 2. FOOD AND BEVERAGE. At or before arrival at the VILLA, you should inform the staff in writing of your menu and meal requests and other special requirements, and we will use our best efforts to comply with such requests. Reasonable advance notice will be required for any unique dietary or non-standard food requests. You will be responsible for advance payment or reimbursement to us of the actual cost of groceries, consumable foodstuffs, beverages and alcohol either ordered for the requested meals and drink selections or consumed from VILLA storage, wine cellar, liquor supply and foodstuffs during the term of the rental. No refund will be made for food or supplies ordered in anticipation of or at your request for meals and beverage service that is for any reason not consumed during the term of the rental. We typically tell guests that they will pay approximately $50 USD per person per day. Granted that depends on the palate the guests have and how gourmet or basic they would like their meals to be during their stay at Bon Vivant Villa. In other words, the per diem rate per person could be as low as $20 USD if the guests choose to eat simpler menu items such as salads, sandwiches, rotis, etc. Please discuss and arrange menu and groceries with Esma Griffith before arrival. Obviously for children who are under the drinking age, that per diem amount is less. The payment for food and beverages will be wired to the house manager, Esma Griffith, so she will be able to purchase the requested groceries and beverages for guest prior to their arrival. 3. STAFF. Professionally trained and dedicated staff at the VILLA, including private chefs, butlers/hosts, maids/housekeepers, security, gardeners, management and maintenance personnel shall at all times work and be under our control, but shall be available to accommodate your reasonable requests and needs during the rental. If you request additional services (such as child care services or chauffeur services) from VILLA staff, such arrangements must be arranged so as to not interfere with staff’s primary duties, and shall be a matter of independent agreement and compensation between you and the staff, for which we bear no responsibility. 4. GRATUITIES. Our staff members are all exceptionally hard working and dedicated to your total enjoyment, satisfaction and relaxation during your vacation with us. To help compensate them for their extraordinary efforts, we ask for a minimum 10% gratuity to be paid at the end of your stay with us. All gratuities should be given to the VILLA’s designated head of the household staff, Esma Griffith, who will use a fair and equitable distribution formula to ensure each member of our staff is appropriately recognized. 5. VILLA USAGE AND OCCUPANCY. Use of the VILLA is provided to you as our guest, and we ask you to treat our vacation home with the care one would expect of a luxury home of this caliber. Any guest, visitor or member of your group found to be mistreating the VILLA may be removed from the VILLA immediately, not allowed to return without refund or adjustment of monies paid. You agree to be liable for any damage or destruction caused to the VILLA or any of its contents by you, your guests or invitees. a. You agree to tell us in advance the names of all REGISTERED GUESTS, which may not exceed the TOTAL NUMBER OF REGISTERED GUESTS below without our written permission. The names of the REGISTERED GUESTS may be changed or supplemented up until the date of your arrival. b. You may also have a reasonable number of INVITED GUESTS whom you wish to visit the VILLA during your stay but not reside overnight. We need to know the names of these people in advance of their arrival at the VILLA. The security personnel of the VILLA have been instructed to prevent unauthorized access to the VILLA to help ensure your privacy and security as well as that of the property, and any person not on the list of either registered guests or their list of invited guests may be denied entrance or instructed to leave the VILLA grounds at any time. If you are planning a wedding or other major event at the VILLA, please let us know well in advance so we may make appropriate preparation and discuss potential additional costs for security or service. All guests at the VILLA, registered and otherwise, must conform to the rules, regulations, terms and conditions of presence at the VILLA. 6. CHECK-IN / CHECK-OUT. Our standard check in time is 3:00pm on the COMMENCEMENT DATE and check out is 11:00am on the DEPARTURE DATE. However, we always want to work to make your visit stress free and recognize that your international travel plans may require adjustments to these times. Just let us know when your travel plans have you arriving and if at all possible we will accommodate your schedule instead of making you conform to ours. 7. ADDITIONAL TERMS. a. Upon check-in, you agree to read and adhere to the guidelines for use of the VILLA for your own safety and security and the safety of other persons and property. If you would like to review these guidelines ahead of time, just let us know and we will be happy to provide a copy. b. Smoking is not permitted within the interior space of the VILLA but may be done outside on the terraces, in the gardens or around the swimming pool. c. No pets of any kind are allowed on the property. d. The VILLA is equipped with an electronic safe that is programmed to your individual code upon check-in. There is a $100 USD fee if you forget your code and forced entry into the safe is required to return your valuables. e. Parking is available at no extra charge on the VILLA grounds for a limited number of vehicles. All transportation to, from and around the VILLA is your responsibility and expense. We are able to assist in the arrangement of transportation upon request. There is no fee for this service except for the fees charged by the transportation company, and all payments you or your guests incur should be paid directly to the transportation provider. f. You and we agree, in the case of any contractual dispute to have the case heard exclusively in the courts of the State Of Maryland, United States of America, and consent to the jurisdiction of said courts over any such dispute, for which Maryland law shall be applied. Both you and we agree, represent and warrant that the offer to enter into this agreement and our execution of this agreement is being made by us at our offices in the State of Maryland, and that you submit and irrevocably consent to personal jurisdiction over you in such courts for purposes of interpreting and enforcing this agreement. The provisions of this agreement may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties. 8. WAIVER AND RELEASE FROM LIABILITY. During your stay at the VILLA, you and your guests may chose to participate in certain activities that may have certain risk associated with them, including but not limited to swimming, use of exercise facilities, use of the beach and ocean access, and the like. By signing this agreement you certify on behalf of yourself and your guests that we will not be responsible for any injury or damage of any type accruing or occurring to you or your guests as a result of your presence at and use of the VILLA and its associated amenities, and you agree to indemnify and hold us harmless as to any claims made against us from you or any person directly or indirectly utilizing the VILLA or its facilities and services under this agreement.
